Renting Terms 2005
§ 1 Tenancy agreement / Number of occupants
The tenancy agreement confirms the agreement between the tenant and Tyrkiets Boligudlejning (hereinafter called 'the agent'). The agreement is final. The tenancy agreement concerns the herein-specified property with the specified specifications. The number of occupants (over 2 years old) must not exceed the number specified in the agreement.
§ 2 Pets / insects
Pets are only allowed if specified in the tenancy agreement in accordance with what has been agreed with the owner. Only the number of pets specified is allowed. Neither the agent nor the owner can be held responsible for insects in or around the property.
§ 3 Cleaning
The rented accommodation has to be held clean during the tenancy and at the vacancy the property will be cleaned by the agent's staff (required). The tenancy is responsible for all effects in the property during the tenancy, and will be held responsible for damages. In the event of damages, the tenant has to inform Tyrkiets Boligudlejning. The tenant will be charged for the cost of unreported damages. Damages or malfunctions, which occurs during the tenancy, will be repaired as soon as possibly. The agent does not have an insurance that covers the tenant or his possessions during the tenancy.
§ 4 Payment terms
25% of the rent is due 10 days after receipt of the tenancy agreement. The balance is due 60 days prior to the tenancy commences. For agreements made less than 60 days before the tenancy commences, the entire amount becomes due immediately upon receipt of the tenancy agreement. All prices are exclusive of electricity, heating, extra equipment etc. These items will be billed separately.
§ 5 Deposit
The agent will ask for a deposit when the key is handed over. The deposit will be returned when the property is vacated, and the property has been inspected and found to be in satisfactory condition. Usage of electricity, fuel etc. can not be subtracted in the deposit, but will be billed upon departure. Please refer to the catalogue information for the specific accommodation.
§ 6 Complaints
In the event there are any complaints about the rented accommodation, this has to be reported to the agent in writing within 48 hours after the property is occupied. Complaint about the cleanliness of the property has to be reported to the agent immediately after moving in. Failing that the tenant is responsible for any irregularities.
§ 7 Cancellation
In the event of a cancellation more than 60 days before the commencement of the tenancy, 15% of the gross rent has to be paid, with a minimum of €67,00. For cancellations within 60 days of the commencement of the tenancy the gross amount has to be paid in full. If the agent is able to re-let the property for that period, the amount minus 15% will be returned. If re-letting of that period is unsuccessful, no monies will be returned.
Any changes to the tenancy agreement up to 60 days before the tenancy commences will incur a service charge of € 40,00. After this point any changes are no longer possible. At cancellations service charges and administrative charges will not be refunded.
§ 8 Acts of God
The tenancy agreement can be cancelled by the agent with no prior warning in the event of an Act of God, strikes etc., or other circumstances that the agent does not have any influence on.
§ 9 Insurance / cancellation due to illness
Insurance and cancellation insurance has to be undertaken by the tenant.
§ 10 Misprints
The agent can not be held responsible for any misprints on the web page.
§ 11 Disputes
Any disputes regarding the tenancy agreement has to be settled at the location of the rented property, according to the Lugano convention. Turkish law will apply.
